Most people are going to say no, but if you can drive safer than everyone else on the road despite being intoxicated, I don't see why it's any less responsible than the way these other people are driving.

But the odds that you do hurt someone is dramatically higher by doing so. So is that equitable under the law to Janice and her 2 kids you killed while doing it?

Pretty sure negligent homicide is a charge in many places.

It's not dramatically higher. I saw *four* deer while on a drive just last night. Didn't hit any. I've seen many animals and avoided collisions on many occasions while driving drunk and high, although most often just high.

I've actively avoided collisions that would have been the fault of other drivers.

But it's a conscious decision to do so

Worse drivers pass their exams for their license. I don't see why you can't have something similar for driving while intoxicated. Or just continue pulling over people who are driving erratically, and charge them based on their erratic driving and not on the basis that they're intoxicated.

You could even go so far as to just add it to the demerit point system, and make an infraction while intoxicated cost more points.

If your .08 you get a ticket and a fine, they call someone to come get you. If your .15 that's a trip to the big house

If you drive well enough absolutely shitfaced you won't get pulled over anyway. Kinda works itself out.

Of course, I avoid the problem entirely by driving so well I don't get pulled over. But in the event that I go into a store and smell like weed, and a cop sees me pulling out of the parking lot in a car, I don't see why that should land me any punishment.

I think erratic driving should be the basis of any stop. DUI checkpoints and staking out the local bar should be against policy or against the law as entrapment.

Instead the police spend resources here terrorising 17 year olds for selling weed, and other more mundane stuff.

Either way, I'm a pragmatic anarchist. Any reduction in government pleases me. That's why I actually vote, unlike 99% of other anarchists.

Small, insignificant county, where nobody’s remember your name. Bumfuck nowhere basically. 95% of incarcerations were meth related. Armed burglary while high on dope is pretty common amongst the recidivists here.

It’s not about making drugs go away. Drugs will never go away and always be a problem. The main argument is freedom

The state has no right to tell you what you can or can not put in your body, and the state has no right to tell you what you can or can’t sell. Whether or not drugs are good or bad is wholly irrelevant.

Weed....meh, don't care so much but I think people in some forms of employment should be restricted. As someone that drives an 80k lbs truck I really don't think drivers need to be able to smoke weed when their on the road

Being that it's an informed conscious decision to drive high af then yes...should be a murder charge. I didn't think so until it happened to my brother in law. 18yo kid drunk af pulled out of a side street and into his bike. Of course it was California and in the end the kid wasn't charged at all

Proving intent is extremely hard. And leaving that open to judges can be a dangerous game.

Until the court intrigue around self defense shootings ends, people will continue being victims of drug induced/related criminal behavior
