If you start something as an aggressor and then attempt to get away and then the other person goes back after you with a more lethal force and verbal threats of death the law will definitely be on the guys side that retreating

I'm a bit fuzzy since it's been a while since I've taken law, but I think the general requirements were having a credible threat of violence, capability of said violence, and not being the aggressor of the situation. If an old karen threatens to tear your arms off and really seems like she means it, that's not justifiable because she doesn't have the reasonable capability. If she says she'll stab you, and is holding a knife, but you said you'd knock her block off first, also not justified. If you said her coupon was expired so she pulled the knife, threatens to stab you, and is reasonably capable of doing so with your life being in immediate danger, then it's justifiable.

Yes, I think the distinction/debate here is whether they decide he was still the aggressor, or if he had retreated and was no longer considered the aggressor
